Terms of Service

Welcome to OHMS: Ohio Music Scene (“OHMS,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the OHMS website, mobile app, community features, radio stream, event calendar, reviews, archive-related sections, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. What OHMS Is

OHMS is a platform centered on Ohio music culture. Depending on the part of the Service you use, OHMS may offer:

  • community discussion and member profiles

  • user-created posts, replies, categories, and shares

  • an internet radio stream

  • an event calendar and event submission tools

  • public reviews

  • archive, wiki, civic club, label, studio, store, and related informational sections

  • links to third-party websites, social platforms, and external services

Some features are informational only. Others allow user submissions and account creation.

2. Eligibility

You must be old enough to legally agree to these Terms in your location. If you are under the age of majority, you may use the Services only with permission from a parent or legal guardian.

You are responsible for making sure your use of the Services is lawful where you are located.

3. Accounts

Some parts of OHMS, especially the Community, require an account.

When you create an account, you agree to:

  • provide accurate and current information

  • keep your login credentials confidential

  • use a valid email address you control

  • be responsible for activity that occurs under your account

We may require email verification before certain account functions are fully available.

You may not:

  • impersonate another person or group

  • use another person’s account without permission

  • create accounts for abuse, spam, harassment, or ban evasion

  • use usernames intended to mislead others into believing you are OHMS staff, another user, or a public figure

We may suspend, limit, or remove accounts that violate these Terms or harm the community.

4. Community Rules

If you use OHMS Community features, you agree not to post, upload, share, transmit, or otherwise make available content that:

  • is unlawful, defamatory, fraudulent, or deceptive

  • harasses, threatens, stalks, abuses, or intimidates others

  • contains hate speech or promotes violence

  • invades another person’s privacy

  • impersonates a person, band, venue, label, or organization

  • promotes scams, malware, phishing, or other harmful conduct

  • infringes someone else’s intellectual property rights

  • is sexually exploitative, graphic, or otherwise inappropriate for the platform

  • is spam, repetitive self-promotion, or fake engagement

  • interferes with the operation or integrity of the Services

You also agree not to misuse reporting, blocking, tagging, notifications, or moderation systems.

OHMS may remove content, restrict visibility, suspend accounts, or take other action at our discretion to protect the community and platform.

5. User Content

You retain ownership of content you submit to OHMS, including things like:

  • community posts and replies

  • profile text and images

  • event submissions

  • reviews

  • uploaded images and similar materials

By submitting content, you give OHMS a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, adapt, distribute, and use that content as needed to operate, improve, promote, archive, and provide the Services.

This includes, for example:

  • displaying your post in the community

  • showing your review publicly

  • publishing an approved event to the calendar

  • storing and serving uploaded images

  • using content in app and website layouts, feeds, previews, and shares

You represent that you have the rights needed to submit the content and grant that license.

6. Reviews

OHMS may allow users to submit public reviews.

By submitting a review, you agree that:

  • your review may appear publicly on the website and/or app

  • your chosen display name, rating, text, and any optional uploaded image may be shown publicly

  • your review should be honest and based on real experience

  • OHMS may remove reviews that are abusive, misleading, spammy, unlawful, or otherwise inappropriate

At the time of this draft, reviews may appear publicly immediately after submission.

7. Event Submissions

OHMS may allow users to submit events for inclusion on the calendar.

By submitting an event, you agree that:

  • the information you provide is accurate to the best of your knowledge

  • you have the right to submit the event information and any attached flyer/image

  • OHMS may review, edit, decline, delay, or remove event submissions

  • submission does not guarantee publication

At the time of this draft, event submissions are intended to be reviewed before appearing publicly.

8. Radio and Streaming Features

OHMS may offer streaming audio and related radio features.

We do not guarantee:

  • uninterrupted playback

  • constant stream availability

  • compatibility with every device or network

  • continuous metadata accuracy, including now-playing information, album art, or schedule data

Streaming quality may vary based on your device, app version, network, third-party providers, and related technical systems.

9. Moderation, Reports, and Blocking

OHMS may provide tools such as:

  • reporting posts, replies, or categories

  • blocking other members

  • account visibility/privacy settings

  • moderation or admin review tools

We may investigate reports but are not required to act on every report in a specific way or timeframe.

Blocking and privacy tools are provided as platform features, but no tool can guarantee total prevention of unwanted contact, visibility, or misuse.

10. Privacy and Public/Private Content

Some parts of the Services are public, and some are private or member-only.

Examples:

  • your email address may be used privately for account access and verification

  • your public profile settings may determine how visible your profile and wall are to other members

  • reviews and calendar entries may be publicly visible

  • some account and moderation data may only be visible to you or OHMS admins

Your use of the Services is also governed by the OHMS Privacy Policy.

11. Device Features and Permissions

Depending on your device, platform, and the features you use, OHMS may request or rely on access to certain device capabilities.

Current or likely permissions/capabilities include:

  • Photos / media access so you can attach profile images, post images, review photos, and event flyers

  • Notifications so OHMS can send community-related or app-related notifications, including replies, mentions, shares, or other updates

  • Audio playback / background playback so radio and other audio features can continue playing when supported by the device and operating system

  • Storage or media library access where needed for selecting or handling uploaded media on certain devices or older Android behaviors

  • Internet/network access to stream radio, load community content, retrieve calendar items, fetch website/app data, and access external links

OHMS may request additional permissions in the future if the Services evolve. Possible future features could include, for example:

  • expanded media tools

  • camera-based uploads

  • microphone-based submissions or recording tools

  • richer archive contribution workflows

  • improved notification systems

  • additional community, publishing, or creator features

If a future version of OHMS requests new permissions, those permissions are intended to support new or expanded features. You may decline permissions, but some features may not work properly without them.

12. Third-Party Services and Links

OHMS may rely on or link to third-party services, including but not limited to:

  • streaming or broadcast providers

  • email delivery providers

  • image hosting or cloud storage providers

  • Google Calendar or related event/calendar tools

  • maps or address lookup tools

  • external social media platforms

  • third-party websites opened from links in the app or website

We are not responsible for third-party services, content, policies, uptime, or practices. Your use of third-party services is governed by their own terms and privacy policies.

13. Intellectual Property

The OHMS name, branding, design elements, text, graphics, logos, curation, and original service content may be protected by intellectual property laws.

Except for your own content and lawful uses allowed by these Terms or applicable law, you may not copy, reproduce, distribute, republish, scrape, modify, or exploit OHMS materials without permission.

If you believe content on OHMS infringes your rights, contact us with enough detail for us to review the claim.

14. No Warranty

The Services are provided on an “as is” and “as available” basis.

To the fullest extent allowed by law, OHMS disclaims warranties of any kind, express or implied, including warranties of:

  • merchantability

  • fitness for a particular purpose

  • non-infringement

  • availability

  • accuracy

  • security

  • uninterrupted operation

We do not promise that the Services will always be available, error-free, secure, or free from data loss.

15. Limitation of Liability

To the fullest extent allowed by law, OHMS and its operators, contributors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, or similar losses arising out of or related to your use of the Services.

If liability cannot be excluded, it will be limited to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless OHMS and its operators from claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your content

  • your misuse of the Services

  • your violation of these Terms

  • your violation of another person’s rights

17. Changes to the Services

OHMS may change, suspend, remove, or add features at any time.

Because OHMS is an evolving project, community platform, and cultural initiative, parts of the app and website may expand, reorganize, or change over time. That includes community tools, archive functions, event workflows, streaming features, reviews, and linked project sections.

We are not obligated to preserve any specific feature forever.

18. Changes to These Terms

We may update these Terms from time to time.

When we do, we may revise the effective date and post the updated Terms on the website and/or in the app. Your continued use of the Services after updated Terms take effect means you accept the revised Terms.

19. Termination

You may stop using the Services at any time.

We may suspend or terminate access to some or all of the Services if we believe you violated these Terms, created risk for users or OHMS, or used the Services in a harmful or unlawful way.

Termination does not erase provisions that should reasonably survive, including sections about user content licenses, disclaimers, limitations of liability, indemnification, and dispute-related provisions.

20. Governing Law

These Terms will be governed by the laws applicable in the state or jurisdiction from which OHMS operates, without regard to conflict of law principles, unless applicable law requires otherwise.
